Populist Legalism
Populist legalism is another analytical concept seeking to capture the effects of populism on the entire legal system. ‘Populist’ or ‘authoritarian legalism’ includes not only the constitutional exercise of public power, but also the definition of the effects and repercussions of populism in various legal areas and institutions. Thus, ‘populist criminal law’, or ‘populist judiciary’ can be plausible concepts, even if populism as such is postulated as a political phenomenon (rather than one originated in the sui generis development of the legal system).
